What Florida asks for

  • A Florida will needs two attesting witnesses who each sign in the presence of the person making the will and of each other (Fla. Stat. §732.502).
  • A will is valid with witnesses alone, but adding a notarized self-proving affidavit (Fla. Stat. §732.503) means the court does not have to track your witnesses down later. It is standard practice, and it is why a notary attends.
  • A durable power of attorney needs two subscribing witnesses AND a notary, and the notary cannot be one of the two witnesses (Fla. Stat. §709.2105).
  • A living will needs two witnesses, at least one of whom is neither your spouse nor a blood relative (Fla. Stat. §765.302). A healthcare surrogate has the same rule, and the surrogate cannot witness their own appointment (Fla. Stat. §765.202).
  • Nothing should be signed before the appointment. These signatures have to happen in front of the people witnessing them.

Common questions
Do you write the will or give legal advice?
No. We are not a law firm and we do not draft documents, choose language, or advise you on what your plan should say. We handle the signing itself: the notary, the witnesses, the order, and the affidavit. If you don't have documents yet, an estate attorney drafts them and we sign them with you.
Do you really bring the witnesses?
Yes, and it is the part most people get stuck on. A Florida will needs two witnesses, and they should not be people who inherit under it. Most families don't have two neutral adults free on a weekday, so we bring them.
Can my spouse and I sign together?
Yes. A couple signing their documents at the same appointment is one visit at the couple rate, not two separate signings.
Can you come to a hospital or care facility?
Yes, and we do it often, including evenings and weekends. Tell us when you call if the signer's condition or medication may affect the appointment, because the notary has to be satisfied the signer understands what they are signing.
What does everyone need to bring?
The unsigned documents and a valid photo ID for every person signing. Don't sign anything in advance. Florida requires the signatures to happen in front of the notary and the witnesses, so a document signed beforehand usually has to be redone.
