Qué exige Florida
- Un testamento de Florida necesita dos testigos que firmen cada uno en presencia de la persona que hace el testamento y en presencia del otro (Fla. Stat. §732.502).
- Un testamento es válido solo con los testigos, pero añadir una declaración autoprobatoria notarizada (Fla. Stat. §732.503) evita que el tribunal tenga que localizar a sus testigos después. Es la práctica normal, y por eso asiste un notario.
- Un poder notarial duradero necesita dos testigos que lo suscriban Y un notario, y el notario no puede ser uno de los dos testigos (Fla. Stat. §709.2105).
- Un testamento vital necesita dos testigos, y al menos uno no puede ser su cónyuge ni un pariente de sangre (Fla. Stat. §765.302). El sustituto para decisiones médicas tiene la misma regla, y no puede atestiguar su propio nombramiento (Fla. Stat. §765.202).
- No se debe firmar nada antes de la cita. Estas firmas tienen que ocurrir frente a las personas que las atestiguan.
